Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Presgraphics ("Company," "we," "our," or "us"), the operator of MunshiJi by MuneemJi. By accessing, registering for, or using the MunshiJi platform, mobile application, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" shall refer to both you individually and the organization.

2. Description of Service

MunshiJi is a voice-powered AI CRM platform by MuneemJi that provides:

• Automatic call recording via our Android mobile application
• AI-powered transcription of call recordings in 12+ Indian languages
• Intelligent extraction of business data from call conversations (names, phone numbers, emails, requirements, budgets, timelines, and more)
• CRM functionality including contact management, deal tracking, and activity logging
• AI Copilot for conversational insights and voice-based search
• Team collaboration features with role-based access control
• Analytics and reporting dashboards
• API access for integration with third-party tools (available on select plans)

3. Account Registration & Security

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent purposes. Each user must maintain a single account unless explicitly authorized for multiple accounts under an organizational plan.

4. Call Recording Compliance

You acknowledge and agree to the following:

• You are solely responsible for ensuring that your use of the call recording feature complies with all applicable federal, state, and local laws and regulations
• You will obtain all necessary consents before recording any call, as required by the laws of your jurisdiction and the jurisdiction of the other call participants
• You will not use the recording feature for any illegal, unethical, or unauthorized purpose
• You will not record confidential communications (such as attorney-client privileged conversations) without explicit authorization from all parties
• You understand that violations of call recording laws can result in civil and criminal penalties, and MunshiJi shall bear no responsibility for such violations
• You will use the optional call announcement feature or otherwise inform call participants about the recording as required by applicable law

5. Subscription Plans & Payments

MunshiJi offers multiple subscription plans, including a free Starter plan and paid plans with enhanced features. By subscribing to a paid plan:

• You authorize us to charge the applicable subscription fees to your chosen payment method
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (GST)
• We reserve the right to modify pricing with 30 days prior notice. Existing subscribers will be grandfathered at their current rate until the end of their current billing period
• Refunds are available within 14 days of purchase for paid plans, as described in our refund policy

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Record calls without proper consent or in violation of wiretapping/eavesdropping laws
• Upload, transmit, or distribute malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other accounts, computer systems, or networks
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for spam, phishing, or other deceptive communications
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or sublicense access to the Service without authorization
• Use the AI features to generate misleading, defamatory, or harmful content
• Circumvent any usage limits, security measures, or access restrictions

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, AI models, and underlying technology, is owned by Presgraphics and is protected by Indian and international intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

You retain ownership of all data you input into the Service, including call recordings, contact information, and CRM data. By using the Service, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing and improving the Service.

8. Data Ownership & Portability

Your data belongs to you. You can export your CRM data, contact lists, and call recordings at any time through the platform's export functionality. Upon account termination, you will have 30 days to export your data before it is permanently deleted from our systems.

9. Service Availability & Modifications

We strive to maintain 99.9% uptime for the Service but do not guarantee uninterrupted availability. We may perform scheduled maintenance, which will be communicated in advance. We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice. For Enterprise plan customers, specific SLA terms are governed by separate agreements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Presgraphics and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

11. Indemnification

You agree to indemnify, defend, and hold harmless Presgraphics from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any call recording or data protection laws; or (d) your infringement of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and you must cease all use of the Service.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India. Before initiating any legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a minimum period of 30 days.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice within the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
